Legal Question in Criminal Law in California
My husband was leaving gas station when a man who had his face covered and had a gun. Got in the truck and kidnapped my husband. Pointing the gun in his face, order him to give him his money, shoes, CD player and cellphone. Then after the man got off the truck and took off running. So my husband followed him with out him knowing and saw the man go into an appartment. Husband called 911, told police what happen. My question is what can police do in this case? Can they go in and arrest the mad?
1 Answer from Attorneys
Absolutely, if they know who he is. If the police haven't arrested him already it probably means that they don't know who he is, that they haven't been able to find him, or that they are not yet convinced that your husband's account of what happened is accurate.
