Legal Question in Criminal Law in California

My ex husband and I were ordered to pay restitution while we were married in a criminal case, can we seperate this restitution now the marraige was annuled 5 years later due to the fact he never divorced his first wife

Probably not. You and your "ex-husband" are probably jointly and severally liable for the restitution in the criminal case. This is mostly likely due to you being co-defendants and not because of your marital status. Perhaps another attorney can provide a more detailed answer.
