Legal Question in Criminal Law in California

Identity Theft problem

i need some help resolving a matter in which another unknown party that i am not aquainted with, got caught without a license and various other fines. the party used my personal information, most importantly my name and address, and now due to that, the court and also the collections agency is pursuing me not only in fines but for questioning.... i am fully not responsible for this matter...its a case of someone giving false information...but they keep suggesting i still have to go down to the court and do a signature test to prove my innocence.. im asking if there is any other way i can resolve this without having to go down there to the court... i have numerous reasons why i cant or wouldnt be able to make it there which are valid. i am innocent and need help resolving this as soon as possible.

These wrong identification problems can cause you a life time of problems. Your best bet is to contact the D. A. and cooperate. Or if the matter is still under investigation by the police cooperate. Or you can wait around until the case goes to warrant, spend some time in jail waiting to see the judge, and be properly identified.

You have some control over the situation now, and that might not be the case if you don't cooperate. There's a very real possiblity that the person that is using your identity is someone you know.

If you do not wish to personally deal with it, an attorney can make preliminary appearances on your behalf. Furthermore, an attorney may be able to pursuade the interested parties that this is a case of identity theft and go after the perpetrator. Please call me directly at (619) 222-3504.

Re: Identity Theft problem

Thanks for your posting. As some of the other responding attorneys have mentioned, you probably should go to the court to have this taken care of.

One of the things you should have done first, and you did not mention whether or not you did, is make a police report regarding the incident. Theft of your identity, or use of documents regarding your identity falsely, are both crimes, and the perpetrator should be punished.

You can hire an attorney to go to court and present a motion to the court, with the handwriting test and a fingerprint test attached as exhibits, which might clear you from this matter.

If you have more questions about any of this, or need help, please feel free to call me toll free at 1-877-568-2977. Thanks, and best of luck.
