Legal Question in Criminal Law in California
Illegal Use of ATM card
I just found out through an acquaintance who stole and used my ATM card. (I had a feeling but could never confirm.) This was done 1 1/2 years ago. Is there a statute of limitation on me pressing charges on this person for doing this.

An individual cannot press charges. you can report this to the police or the district attorney. they will evaluate the facts of your case and determine whether to file a complaint for criminal charges. the time limit would depend upon the facts of your case. If the amount taken is sufficient to be a felony then the statute of limitations is 3 years. If fraud is involved then the statue of limitations may not have began to run until you discovered the fraud.
