Is it illegal to with hold an employees paychecks if the were arrested for grand theft embezzelment but not convicted yet?

It is my understanding that you cannot withhold an employee's paycheck. If you do not pay the employee at the time prescribed by statute, you are liable to a penalty of one days wages for each day the pay check is late in being delivered to the employee.

To the best of my knowledge, you can withhold their paycheck for a period of time while investigation is pending but ultimately, it must be distributed.
