Illegal tape recording?

Is it illegal to tape record a conversation between a detective and a citizen without them knowning?

The answer depends upon who makes the recording and under what circumstances. It's probably legal if the conversation is actually an interview conducted as part of an ongoing investigation and if the detective (or someone working with her) makes the recording. It would probably be illegal under most other circumstances.
