Legal Question in Criminal Law in California

Is this illigle search and seizure

Police knocked on motel door early a.m. initially wanted to talk to my boyfriend-After info was received from him.Handcuffs were placed on him. That should have been it. However, the police started searching my room. found paraphinelia, and kept searching. Long story short we both were taken to jail, and he wasn't even charged with what was originally said. At the police station, they could not find anything on me so the cop resorted to saying I was under the influence, I took all test including urine. I had to stay in jail for two days, I guess for being under the influence, yet there were no results, until my second court appearence. Everything involving this case is suspicious...

Re: Is this illigle search and seizure

This is pretty much a standard police search of motel rooms. Your question is of course was it legal.

As to your boyfriend I don't know. Was he on probation, and had he waived his 4th Amendment Rights? As to you the the same question. I don't have sufficient facts to offer you an opinion as to the legality of the search.

You want to run with boyfriends that have been convicted of crimes, you can expect to spend some time in jail. Eventually you'll get convicted of something and the search will be legal because you've waived your 4th Amendment Rights.

Lots of luck
