Legal Question in Criminal Law in California
An incident occured 4 months back with my brother whom has a extensive record in domestic abuse with me. an argument arose and he started making threats towards me and pushing up at me. i threw my hand up to block his punch and he says that i hit him and called the cops on me so i called the cops on him. the cops said he had delt with him on several occasions and knew his behavior and said that we would should not be in each others company. we both agreed not to press charges and just stay away. well he called my husbands phone trying to come to my home and i said no he became angry and threatened to press charges. im scared i will be unjustfully aressted. can i get in trouble for this? i mean he says one thing about the situation when its not that way and im telling the police another thing. im scared as im have always been a law abiding citizen and do not deserve this. hes using that incident to bully me. whats going to happen.

He will keep on bullying you until you take a strong stand against him. The police officer made a report of the prior incident and that there was no basis for charges to be pressed. Do you really think the police are going to believe a person with several run ins with the police for domestic violence, claiming that a woman hit him 4 months ago and that he has now decided finally to press charges? He has no case and he knows it. Tell him to stop bothering you or you will call the police as to his disorderly conduct. You have nothing to be afraid of except that your attitude will result in you being taken advantage of.
