Legal Question in Criminal Law in California

Innocent

How can I clear my good for a crime I did not commit, even though I was ill instructed to enter a plea of guilty by my Public Defender? My ex-wife made a false report of USE OF FORCE OR VIOLENCE against her which was not true. She tried recanting her story and wanted to drop charges, but the DA did not allow her to do so. This happened 13 years ago, I did not comply with the courts punishment due to my innocense.

Re: Innocent

The case is over, and you lost. You did commit the crime. You pled guilty. If you wanted a different result 22 years ago, you should have hired a private lawyer instead of using the public defender. So now you are a fugitive?

Re: Innocent

Looks like there are two problems here. First, you write that you did not comply with the Court's punishment which indicates there might be a warrant out against you now. If this is the case, this means you have a serious issue on your hands which you need to take care of as soon as possible. You should do it with the help of an attorney.

As far as your conviction from 13 years ago goes, you will need to consult with a lawyer about possible legal grounds on which it might be vacated (cancelled). Your claim of innocence will not be sufficient and the lawyer would need to investigate the facts of your case more thoroughly. While vacating a very old domestic violence conviction is not necessarily easy, it might be possible.
