Issued Citation While On DEJ/PC1000/Diversion

I was placed on

DEJ/PC1000/Diverison for posession

of marijuana and concentrated

cannabis in Mammoth, CA. I have

been completeing my classes, but

was cited for possession of under an

ounce of marijuana. I have a medical

marijuana prescription, but did not

have it on me at the time. I officer

assured me that it would be

dismissed when i go to court with my

prescription papers.

How will this affect my Diversion?

Will my judge here in Santa Barbara

be notified or be able to find this out?

Will Mammoth Courts be notified?

What should I do?

Any help is greatly appreciated.

I would try to have the new ticket dismissed as soon as possible, even before any court date. Yes, your DEJ court could find out and this could mean trouble since possession of marijuana was exactly the offense for which you got DEJ. The risk is you would be kicked out of DEJ and placed on Prop. 36. As a medical marijuana patient you have a defense to probation violation but it is tricky in your case because of the specific nature of your probation.
