Legal Question in Criminal Law in California
Johnson Waiver
Please tell me what a johnson waiver is my friend is incarcerated on a new case and he is sending me letters asking me to look up what a johnson waiver is he thinks that it is a way for the courts to trick you into getting more time. And the Public Defender that he has is not help at all.

The case you want which defines this is People v. Johnson (2002) 28 C4th 1050.
Basically, this means a defendant can waive his credits for time served at sentencing in exchange for accepting the maximum sentence on a lesser charge.
