johnson waiver

if you waved credits to get a program with joint-suspended and failed the program, can you get them back to bargain with when facing doing time?

It really depends on the exact plea agreement. If you agreed to waive them for all purposes, then they're gone forever. If you agreed that if you failed out of the program, you wouldn't get good time/work time credits for the time in the program, then those are gone. If you entered into a plea deal where you would agree to waive custody credits and that you wouldn't get ANY credit for the time in the program if you failed, then they're really gone.

Talk to your lawyer that got you this deal.
