Legal Question in Criminal Law in California

Joint Suspension Never Heard of?

My fiance is currently being transported to King's County in CA on a felony warrant for a Violation of Probation, failure to pay, and probably catching a new case. (I came in towards the end of all this and didn't know he wasn't doing what he was supposed to.) I called the probation dept in King's County and asked if he would be able to take a Joint Suspension because I really need him home right now. They informed me that they do not offer joint suspensions and that they've never heard of it. Is this true? Can certain counties not offer something like that or is that supposed to be offered statewide?

Re: Joint Suspension Never Heard of?

Well, your question is clear to me, but maybe was not to the probation officer with whom you spoke. "Joint suspension" is the common term for a sentence to state prison, with "Execution of the sentence suspended", meaning that actually serving the sentence is suspended while he is on good behavior

And yes, this is a state wide concept. Your judge in Kings County could do this if he wanted to. Heavily document his good qualities and how hard working he is. Get letters of recommendation and anything else you can think of to make the judge think he can be trusted to do better and send it directly to the judge, or have his lawyer present it to the judge. The defense is just as authorized to present probation report type information to the judge as the Probation Dept is.

If you do send a submittal to the judge, make sure the case number and the date of the court appearance is on the package.
