How does the judge decide which cases to run concurrent? My son was given 16 months and was sent to LA prison. His judge added my son's case in Orange County, California which gave him 16 months plus not signing up for probation in LA. My son was transferred to Orange County, California to take care of his warrant on the same case he just did time for. Will the Orange County judge run his cases concurrent? My son filled out a form to ask the judge if his cases can run concurrent.

It is up to the judge. They can offer him concurrent time to resolve the case or they can add it consecutive. If consecutive, it would be at one third of the midterm for the new case. For example if his new case carries 16 months, 2 years or 3 years, the most he could get consecutive is 8 months (1/3 of 24 months). That's assuming no strikes or other issues.
