Legal Question in Criminal Law in California
How can I get a judge to lift a no contact order?
The judge imposed the order because of a Domestic Violence charge (misdemeanor) charge against me that my husband has plead guilty to and sole responsibility for. My husband will be receiving anger management classes and will be released from custody into a drug treatment facility. He was recently diagnosed with bi-polar disorder and ADHD and is currently taking meds. We have been married for 22 years and 20 of those years were very good and substance/violence free. We also had a traditional christian (catholic) household and the last 1 1/2years are the exception rather than the rule. I also had a very brief stint with drug use in the last year with my husband (crack-cocaine) but lived a very normal life prior to that. We both worked and had very average life. Because of the circumstances of the last year and a half, we had to file for bankruptcy and I could not hire a private attorney. If anyone can help me, I would greatly appreciate it. I cannot fathom the next 3 years without to contact with him, and our children have relayed that their father also feels the same. Please help I am desparate.

Re: How can I get a judge to lift a no contact order?
In most courts the defendant in this type of case must appear in court periodically to report his or her progress in attending meetings. You could appear at the next court appearance and ask the judge to modify the court order to allow peaceful contact and for you and you husband to live together.
If there is not a court appearance set for soon enough then contact the court clerk and ask that the case be placed on calendar. If you can hire an attorney that would make it easier to accomplish.
