Legal Question in Criminal Law in California
Judge says he has never seen a verdict like this one
The jury came back with a guilty verdict on 2 counts of assault 2 and one count of UPFA but on the special verdict of did he have a gun while committing the assult's, they could not decide they were hung. some jurors didn't want to answer that because they were not sure. so the judge says we will sort it out at sentinsing, this is a contredictory verdict, and sould be grounds for a misstrial, shoulden't it ?
and also I cant get my attorny to keep in touch with me he didn't even start working on this untill we were picking a jury, is there any way to tell the judge that i don't feel that I had a fair trial, and my att, has spent little or no time on this at all. what can I do at this point the motion was made for a miss trial as soon as the verdict came and judge said it woulde'nt be a good idea, what do I do? can I fire my atturnyin open court before he sentanses and get a diffrent att, to pick it up from there?

If your attorney is a screw-up this will work in your favor. The court-appointed appellate attorneys are very good, maybe this is good for you.

Yes, you can retain another attorney for sentencing purposes. Do it soon. Might be a good idea if you really feel your lawyer did not represent you well.
Don't blow the deadline to file notice of appeal and find an appellate lawyer. Feel free to contact me if you are looking for help in Southern California.
