Legal Question in Criminal Law in California

In June my mother was arrested and is currently still on trail. She is charged with insurance fraud, though she is not and never has been involved with any type of fraud. A friend of hers, who use to live with us, planned a coalition on June 25, 2013 and was arrested. So my mother went to see what was going on. My mother had no idea her friend was involved with this type of activity, till that day that she showed up and parked in front of the scene and the police ran over to arrest her because she knew this guy. Nevertheless, I know this guy's story and I know that in reality it was all his plan and fault. I would like to declare what I know about him to get my mother out of this unfair situation, but I am scared to get involved or to get arrested . So my question is should I declare or should I just wait for the trail to keep going? Though I fear my mother can be unfairly convicted

Without having seen the police report and knowing much more about the case I cannot advise you. The best advice I can give you is that you get an attorney, show her/him a copy of the police report and get his/her advice. If that is out of the question for any reason you should talk to your mother's attorney.

If you are a potential witness you need to let your mother's criminal defense attorney know immediately. I don't understand why you have waited until the trial to come forward.
