Legal Question in Criminal Law in California
Juvenile court, 422
My 17 year old son and another kid..13 had an verbal altercation. The kid accused my son of terrorist threats. My son admitted to have a pocket knife in his hand unopened. The other kid said it was open. The kid added to his story saying my son was going to get a gun. Well, my son didn't say that. The kid was harrassing my son and my son decided to scare the kid and told him to knock it off or he would kick his .. or something like that. Cops came to the house and arrested my son for this kid's accusations. My son told the cops everything. They didn't offer current miranda rights. This kid has made accusations about other community kids and these kids ended up in juvenile hall facing charges. This kid has a history of suspensions for fighting and causing trouble. Also, my son's probation officer falsely made comments about my son. This was brought to the courts attention and corrected. She misrepresented the facts on a court paper. I made a statement and she altered it to make it out that my son was a worse kid. He has never been in trouble before. He is an Eagle Scout. Also, the kid's mother is now coming by our house making rude and crude jesters. HELP. Thak you Chris
