Legal Question in Criminal Law in California

juvenile probation

My son was in a fight at his baseball field in May of this year. The police informed us that no charges were being filed against either party so we didn't pursue it. The police assured me that my son would not have anything on record since there were no charges filed. However, we received a letter in the mail that said the police referred my son to probation. Can they do that if we never even knew there were charges? He is 12 years old and the other kid hit him first but they are charging my son with assault and battery according to the letter. They never interviewed any of his teammates at the field so how can they have a case?

Ordinarily, you do not get probation unless charges are filed by the DA and either a plea or a verdict is entered. This will only be done in open court before a judge or judicial officer of some kind. The police may have referred the case to the DA to file charges. The letter which you mentioned in your post would have to be reviewed to more accurately assess the situation.
