Legal Question in Criminal Law in California
Juvenile Strikes
My husband is currently facing the 3 strikes law. His prior 2 strikes were juvenile strikes. He did not sign a plea bargain. He for some reason was not given a right to a trial by jury. If he was not treated with his constitutional rights THEN....can they still count those strikes against him NOW? Would it be useful for his lawyer to file a Romero Motion? Thank you.

Re: Juvenile Strikes
Some, but not all felonies that qualify as adult strikes also count when they are juvenile ajudications. In juvenile court, there is no right to a jury trial.
Your husband's attorney should be looking into attacking the validity of the strikes AND a Romero motion.
