Legal Question in Criminal Law in California
Lawsuit filed w/ fake evidence?!
My mother filed a lawsuit against me claiming that some property I own was suppose to be put into a family trust. She filed the lawsuit with a letter from an attorney claiming he had sent me numerous letters and left messages for me to come into his office and sign trust documents. Since then (January 04), my mother has changed her story, claiming she and I had a partnership. My attorney just called the attorney asking about the trust and his relationship with my mother and me. He said he never heard of my mother, me, and on top of that didn't do trusts. So we're set for trial (January 05) and we're just starting discovery. We're filing a demurrer because my mom changed her story... but what about this ''evidence'' she included in the original complaint? It's forged! Can I get this whole case thrown out? She used this lawsuit to file lis pendens on my titles which have since been removed. What recourse do I have?
