Legal Question in Criminal Law in California

I need to know what this letter means from a DA.

"This letter is written in response to your request for a speedy trial in the following matter: Docket number XXX for charges XXX.

I am requesting that the court recall the warrant in XXX County Docket XXX, reinstate probation and then negatively terminate probation."

Without knowing the specifics, I'll take a guess. You can call me and give me the specifics and I can try to answer more thoroughly.

It sounds like your probation was revoked, which causes it to be tolled. Often when a probation is revoked a warrant for the arrest of the probationer is issued. It sounds like the D.A. Is going to ask the court to find a violation, reinstate the probation (start it back up) and then terminate it unsuccessfully. You have a right to have a hearing before the probation violation is found by the court. One of the effects of the termination of an unsuccessful probation is that if you want to get an "expungement" to remove the conviction from the public record, you will have to show the court that you are deserving of it, whereas, if you had a successful completion of probation the court has to grant the request if the other criteria are met.
