Legal Question in Criminal Law in California
Liable for injury resulting from damaged car
An ex boyfriend threw something at my car while I was in it (in his driveway) and cracked the windshield. When I try to talk to him about fixing it he told me where to get the estimate done. From that point on every time I call about it, he threatens to get a restraining order against me. I had an incident report made by the police but that's all.
1. Can he get a restraining order because of my phone calls? I have stopped contacting him at all for 2 weeks now and don't intend to try anymore.
2; if someone is injuried or there is some kind of accident due to the fact that the windshield is cracked, is he liable for injuries and damages occurring? The police told me that telling me where to take the car for an estimate so he can pay it is as good as admintting guilt. Do you agree?
