Legal Question in Criminal Law in California

libel & Slander

Do I need a lawyer for a Libel or

Slander case. Someone filed a false

police report on me saying I hit them

with a golf club. Police came and I

was arrested and went to jail for two

days. I never made it to court. Iwas

only arrested because the other party

made a citizents arrest. Can I sue for

libel or slander?

Re: libel & Slander

You should consult with an attorney. It would seem to me that the best approach would be to sue for false imprisonment.

You can sue, but you can't win. Police reports are legally privileged and cannot support judgments for libel or slander.

Although you probably don't have a civil case, knowingly making a false police report is a crime. If you believe the person who made the report knew it was false then you should talk to the local prosecutor.
