Legal Question in Criminal Law in California
I live in lake county calif . My question is can the officers take my 17 yr daughter into her room and ask her questions without a parent. Also can thy say degreding things about a parent to them or where she can hear them. Plus do the officers have to read your Miranda rights or anything to you before they take you to jail
1 Answer from Attorneys
Generally, police may question minors without their parents present, and without parent permission. Minors have the same rights as adults when taken into custody, such as being given Miranda warnings before any custodial interrogation, and being allowed to have an attorney present during questioning. Keep in mind that Miranda warnings are not required to arrest, just prior to custodial interrogation. There is a legal difference, and what you see on TV is not accurate.
