The District Attorney has to file charges within the Statute of Limitations.
The Statute of Limitations varies according to the crime.
For misdemeanors, it's usually a year.
For most felonies, or misdemanor "wobblers" that could be charged as a felony, it's three years.
For some felonies, it's longer... and for some felonies, like murder, there is no statute of limitations and the DA can file charges at any time, even decades later.
