Legal Question in Criminal Law in California

Manufacturing Drug Charges Help !!!

A very good friend was arrested 4 months ago while on the property (front yard) of someone he knows and while working on his car the place got raided, they found a methamphetamine drug lab upstairs in the house, my freind not knowing ANYTHING about it was arrested along with the renters of this house. Two days later they released him and dropped all charges, now it is 4 months later and the police came to his door (unexpectedly) and said they had a warrant for his arrest that was just issued the day before stating the warrant was for drug manufacturing and a $250,000.00 bail. How and why can they do this ? He had no knowledge of this going on so the police had to let him go. What are they doing now ?? HELP my friend is in jail again for something he knew nothing about, just wrong place at the wrong time situation.. THANKS SO MUCH

Re: Manufacturing Drug Charges Help !!!

The police do not determine who gets prosecuted

and who does not. The DA's Office does that. The

booking Sgt. obviously felt they had a weak case

against your friend and they undoubtedly did not

yet have lab test results. Nor fingerprints on

whatever equiptment was inside. Why they chose to

charge your friend now could be for many different

reasons. Only a review of all reports could tell

you why. Your friend undoubtedly has high bail set

on him. This may be because the police hope he will

turn state's evidence. He needs competant counsel

to review his case; the Public Defender if he has

no funds. In the end, a delay in filing the case

does not really mean it is sinister. It is relatively

common. Good Luck
