Legal Question in Criminal Law in California
Marijuana Poseesion
Basically, I got caught at a DUI checkpoint under the influence of a controlled substance (not marijuana)
I admitted to having some weed in the car, they took it and left the baggie in my center console
Nowhere on the ticket dose it say ANYTHING about possession
Im assuming these guys smoked it
When i was in the back of the cruiser in handcuffs the cop in the front seat was fiddling around with somthing and a black cop walked up to his window saying ''Weed for later, eh?'' and than he noticed me and shut up abruptly, the arresting officer than replied with ''uh no, its a confiscation''
Im assuming if it was confiscated, it would be on my ticket as a possesion charge
Is there anyway i can use this to fight them? Or is it better just staying quite?

Forget about the cops who stole your weed. You are going to need to defend your criminal case. And you need to learn to shut up when questioned by police. Go to youtube and view the video, Busted: A Citizens Guide To Police Encounters.
Re: Marijuana Poseesion
If they confiscated the weed chances are it will not be used against you and you should thank your lucky stars . . . :)
That said, you have a criminal case and need an attorney as soon as possible. Feel free to contact me directly.
