Legal Question in Criminal Law in California
Marijuana Possesion and Trafficking
i was traveling into california and i had just under 114 grams of marijuana in my car (a quarter pound)and i went to jail for the nigh, i am being prosecuted under state or county...not federal law. I was just wondering what the common or like average punishment is, im still in school and this is the first time i have ever been in trouble with the law, the county i am going to court in is Imperial County. If you could give me any information that would be wonderful thank you

Re: Marijuana Possesion and Trafficking
Like many legal questions, the answer to yours depends on a number of factors: 1) Local attitudes towards MJ (my best guess is Imperial Co is a conservative county, but on the other hand they are on the border and have lots of cases with lots more weight) 2) whether or not you are charged w/ a felony (intent to distribute) 3) whether you can afford a private attorney as opposed to the public defender (big difference) 4) whether you gave a statement to the cop or gave permission to search (if you did either of these, you are too stupid to be carrying QPs around) 5) your ability to take the time and to travel to CA for court hearings and 6) whether you have a medical excuse. The penalty includes the loss of your buds, plus If you are convicted you face probation, fnes, and jail time, up to 5 yrs prob/$10000/1 yr jail, probably much less, and you might have future problems, especially if you are a noncitizen or you have aspirations to be an FBI agent someday.
