My son was given a citation in Santa Barbara for pocession of (1) joint and a open container for Beer. This was in front of a house (on a side walk) where a college age paty was taking place. He is over 18 yrs. and this is his first offense of any kind. What is the expected penalty of for this offense?? Thank you for your reply.

Hello---Thank you for your question. Your son might qualify for a diversion type program that is often available in Santa Barbara. In a case that I appeared on recently there, I was able to get my client into a program where he was able to keep his record clean just by completing all the requirements. It may be that the kind of career your son may compete for would be in jeopardy with a drug conviction, and he may want to pursue all of his availalbe options even on this lesser kind of violation.
