Marijuana -- Weekend Work Release

My boyfriend was resently sentenced to 100 days of Work Release in San Bernardino, for a drug case. We have since relocated to Las Vegas, NV. When he went to pay for his Work Release he found out that he did not have a commitment date to start work. He called his public defender and explained that he was no longer in the state and that he would also need a new commitment date. While he was at the Work Release office at Glen Helen the head of the program told him that he should see if he could get his Work Release transferred closer to Nevada or try for house arrest because he should not have to travel all the way to Glen Helen every week. He explained this to his lawyer and his lawyer said he would have to go back to court for a new commitment date. My boyfriend and myself wanted to be present for this and that was explained to the lawyer. The public defender went to court without us and did not address anything but the commitment date. Now he has to start Saturday. How can we go about trying to get it transferred closer or house arrest? Will a judge approve house arrest in a different state? What can he do about the public defender not telling him when the court date was so that he could be present? Please help.

You will need to go back into court to modify any order that is currently pending. No one besides the judge can honestly tell you what is going to happen. Public defenders are very overworked and have a hard time keeping track of all of the clients. You may want to point out to the judge via your attorney that you did not know about the last hearing if the judge wants to know why you are back again.
