Legal Question in Criminal Law in California

What happens after a Marsden hearing

I have a friend that granted a

marsden hearing and in that event,

his attorney was relieved of duty. At

that point the judge called over the

publice defenders office and someone

came over to take over his case.

Since that point, the public defender

has stated that there is a conflict of

interested and has asked to be

recused from the position. SO, today

there is a hearing to have a new

attorney appointed to my friend but

he is not aware who it will be if

anyone. Can someone please tell me

the process of how that works if the

public does not take the case, what

are the defendants rights?

Re: What happens after a Marsden hearing

A defendant in a criminal case has the right to be represented by an attorney. The defendant does not have a choice as to which attorney will represent him. Courts normally appoint attorneys with experience that qualifies the attorney for that type of case.
