Re: What is a Marsden motion?
A Marsden motion is a request by a criminal defendant to replace his court-appointed attorney. Once the defendant explains what he wants the motion is heard in the judge's chambers. The prosecutor is not allowed to be present so that the defendant and the lawyer can discuss their issues with the court without recealing privileged or confidential information to the other side.
