Legal Question in Criminal Law in California

I meant to ask, if a person can legally sue the spouse of someone who has had criminal charges brought against them, for financial compensation even though there are no charges against the spouse?

You have not provided sufficient information for a response. What did the person with criminal charges do? how was the spouse involved in the criminal conduct?

Being married is not enough to make one spouse liable for the other's conduct. However, the marital community (assuming one exists) can be made to pay a judgment against the responsible spouse. That is true whether his wrongful conduct was criminal or not.
