mechanic won't return my car

My car was hit and totaled while parked outside of my home. The young man who hit me was uninsured. He made a verbal arrangement with me to have his father (a mechanic at a body shop) fix the car. His father stated that it would take about 1 month to complete. It has now been 3 months and I have had contact with the father on and off until now. He won't return my calls and I have even visited his residence but no one came to the door. I have seen the car at the body shop where the repairs are being made and it appears that some work has been done, but the car is no where near drivable. I had a custom paint job on it originally, and that alone will take 2 weeks to complete. Since I gave him permission to take the car to the shop (verbal), what is within my rights as far as taking the car back. This family does not have the income to replace the car which is why I chose to go this route rather than sue for the value of the car. Is there a way I can involve the body shop in responsability for the car, if he is only an employee of the shop? Please let me know if there is any additional information that you would like. Depending upon the amount of the damages you could sue the driver and owner of the vehicle in small claims court.
