Legal Question in Criminal Law in California

Mip

My daugher was with 2 friends at the beach in san diego. Some boys came over and wanted to give them a beer. He left the beer with them, but they poured it out when they left. Later an officer came by and gave them all citations for 25662 (a)BP. Is it worth fighting or should they just plead guilty and pay the fine. the Bottles were there but they did not drink them.

Re: Mip

If it is as they say, then they should take the case to trial. Don't plead guilty for convenience. Good luck.

Re: Mip

The fact that the girls didn't drink the beer isn't all that important. They are charged with possessing the beer, not with drinking it.

At a minimum, you should get your daughter a lawyer. After discussing the facts with her, he will be in a better position to say whether she should plead or not.

Keep in mind that pleading guilty has consequences down the road. It is not something your daughter should do lightly, and certainly not just for the sake of avoiding some inconvenience.
