Legal Question in Criminal Law in California
Miranda Rights
During my arrest I was advised of
my rights. Now the officer does not
say '' now having these rights in
mind do you wish to make a
statement.'' Instead hes says '' I
wanted to talk to you about what
happened.'' So we talked, and when i
go to court He wrote that he taped
our conversation. If he did then i
didnt know about it. Now im
sentensed and i feel like i got
screwed w/ the public
deffender.Whatr he did is that legal?

Re: Miranda Rights
Yes. All the officer has to do to comply with Miranda is to read you your rights. He doesn't also have to ask you if you want to make a statement. You knew you had the right to remain silent, and you should have done so.
