Legal Question in Criminal Law in California
Misdemeanor charge of petty theft, 2nd offense
I'm being charged with petty theft; misdemeanor. This is my 2nd offense of being charged with petty theft, and I believe burglary is also a charge against me, as well. I'm not quite sure what the charges are against me, but I didn't commit this crime. I'm not guilty, and I have a public deffender. My question is, what can I do to keep myself from being convicted of this crime, and to lessen the sentencing on me if I am found guilty. What are my chances of winning this case if I decide to get a real attonery, and not go with the public deffender?

Your public defender IS a "real attorney". What do you think public defenders are, anyway?
If you want a private attorney and can afford one, by all means go hire somebody. Unless and until you do that, I suggest that you have some respect for the knowledge and experience your public defender brings to the table and try listening to his or her advice. And whether you change lawyers or not, you will not be able to get guidance from this web site of anything approaching the quality of work you will get from your own lawyer who actually knows more about the case that you could ever tell us.
