What are the deciding factors as to whether a violation of 4324 a PC is filed as a misdemeanor or a felony?

There is no reason why it would be filed as a misdemeanor. District attorneys always max out the charges. But if all you did was attempt to write yourself for a few Vicodins it will probably be reduced to a misdemeanor later on, assuming you get a halfway competent attorney.
If you were copping Demerol for Michael Jackson, all bets are off.
