Legal Question in Criminal Law in California
Misdemeanor pc 11357B under18
My son was given a citation for pc 11357B (possession of Marijuana). He was 17 years old at the time. He never got a notice to appear or anything regarding the citation until approximately 6 months after the incident. He is scheduled for a Misdemeanor Hearing. He is now 18 years old. Will they treat this as a juvenile offence or as an Adult offence? Will this remain on his permanent record as an Adult since he is now 18 years old? What should we expect? Should we obtain an attorney? Thank you in advance.

They should treat the charge as of the time of the arrest, which is when he was 17 and a minor. You should hire a lawyer proficient in the marijuana laws. Good luck.
