Legal Question in Criminal Law in California
misdemeanor ticket
ok here's what happened, i was at fair and my friend told me to break up some marijuana for her, some bicycle cops passed and caught me. they issued me a misdemeanor ticket for possession of marijuna less than 1 oz. since i had it. I asked the cop if anything stays on my record he said no just pay the fine. I'm just concerned because I'm a good college student that needs financial aid and there is a question on the financial aid that says if convicted of possesion of marijuana or selling that I must have completed rehab in order to apply. I want to know if ''conviction'' applies to my situation (because its not like I was arrested and they made me go to rehab), and also if it does stay on my record for how long?

Re: misdemeanor ticket
The ticket will be on your record as a possession charge. If you pled guilty to the ticket, then answer the application honestly. If you have not yet appeared in court on the ticket or otherwise resolved it, answer the application as if you have not been convicted. Worst case is that you complete rehab. Good luck.
Re: misdemeanor ticket
You are elibile for DEJ. See my website (http://www.wzlawyers.com/marijuana_laws.htm) or ask the public defender do this. You can enter a plea of no contest, then do a short program, then come back to court to get it dismissed.
