Legal Question in Criminal Law in California
mistaken identity
My husband's drug-addled klepto brother who is now serving time for theft has a history of giving my husband's identity when arrested. All instances have been cleared up until now. Last year, unbeknownst to us, the said brother was either arrested or cited for possession of meth and paraphernalia. We find out 9 months later that my husband is now wanted for felony possession. We have made an appointment to speak with a judge soon as possible. I'm wondering what are the chances that we can clear this up with a possible mug shot or fingerprint set, if the brother had been processed. Our worry is that he may have just been given a citation to appear in court and, apparently, didn't. What is your opinion and/or advice. If possible... much appreciation.

You DO NOT attempt to speak to the judge or the DA or anyone else for that matter except your own lawyer. Only your own lawyer will know the best way to protect you. Others will be either indifferent to your welfare or outright hostile and wanting to incriminate you.
A short inexpensive or maybe even altogether free consultation might suffice for you to obtain the advice you need.
