Legal Question in Criminal Law in California

Misuse of handicap placard

Hello. I am disabled with a broken right ankle and was issued a disabled placard. Being my right ankle I cannot drive. My girlfriend drives me around everywhere. Today she received a misdemeanor because she dropped me off at my class, parked in a handicap space next to her class, then was going to coem get me afterwards. We were both on campus together, but I was not with her when she returned to the handicapped car. The car is also mine. She must appear in court. Is there anything specific she/we can say or do for chances of a lower punishment. Thank you.

Re: Misuse of handicap placard

If your girlfriend parked in the HC spot for her own purposes, there is little you can do to fight the ticket. But if she parked your car in the HC spot for your benefit, then you might have a chance. What I don't understand is why your girlfriend was cited if there is a HC placard in the car. ???

Re: Misuse of handicap placard

In a nutshell, your girlfriend has a VERY good defense to either excuse, justify or mitigate the citation against her, since she was parked in the space at issue for your benefit, not her own. If you would like prompt, affordable assistance in this matter, contact us today for a free phone consultation, especially if the handicapped placard was present in your vehicle at the time of her citation.
