Legal Question in Criminal Law in California
Modification of sentence
I was sentenced to 20 days in jail and summary probation on June 21,2002. I served out my sentence and noticed that they did not take off 2 days served as stated at the time of sentencing. I informed my lawyer and he went back to court for modifiation. At this time the judge decided to put me on formal probation. My lawyer instructed me to contact probation. I did not agree to this and am wondering if they can change the terms of sentencing 6 months down the road?

Re: Modification of sentence
Typically, a failure to comply with terms of probation can subject one to being re-sentenced.
