Legal Question in Criminal Law in California
if my mom has faked calling the cops on me in the past would her calling the cops on me recording with me in the background yelling to the phone even though I didn't know she was really on the phone with them be allowed in the state of California would that be allowed at my criminal trial as evidence
1 Answer from Attorneys
I don't see why not. There's no rule that excludes otherwise admissible recordings of emergency calls just because someone else in the room believed the caller was bluffing. It's hard to see how such a rule would serve the interests of justice.
You mention a criminal trial, so I take it you either have been charged with something or at least believe you will be. You should get a defense attorney ASAP if you don't already have one. The court will appoint one for you if you can't afford to hire one privately.
Good luck.
