The last time I looked at the official statute for California, where the amount is $450 or or more then you will incur a bad check felony charge.
Bad check penalties can include a jail sentence of up to 3 years in STATE prison if the offense was charged as a felony. Any amount less than that will equal a misdemeanor charge, which brings with it a maximum jail sentence of 1 year in county jail.

If the person has a prior offense for theft, and that offense involves a 470PC or 476PC, then the offense could be a felony. It depends on some more facts that you don't provide. Are you forging a check, or just cashing a check that someone else wrote to you on insufficient funds?
