Legal Question in Criminal Law in California

murder case question

My boyfriend is currently serving a 15- life sentance. He was charged with murder 2 for a hit and run. One man died. He turned himself in the same night. The victims family had political ties which we believe had part in his sentance. He is currenty on his twelth year in prison with no perole date. Is there anything that a lawer could do to atleast get him a perole date? Thank You for your time and help.

Re: murder case question

If he is serving 15-life, he is not eligible for parole until he serves his 15. It looks like you want to know about Az law. I don't practice in Arizona--only California. In California, the most he would be eligible for is 15% credit on a second degree murder conviction. Until he reaches 15 years less 15%, he is not eligible for parole. You need to look at how Az calculates custodial credits for determining when he is eligible. Under CA law, parole is not automatic in a 15-Life sentence.
