murder charge - when can it be lowered?
At what points can a murder charge be lowered? If a person is charged with murder and goes to trial, does the jury only deliberate on the exact charge?
Also, is it normal for the prosecution to not make an offer but wait for the defense to make an offer?

The defense has the option of letting the jury be instructed on lesser included offenses, e.g. manslaughter or can gamble all or nothing on M1.
