Legal Question in Criminal Law in California
about murder
my question, my parents just went though a divorce about 5 months ago, a lot of stuff has happend before and after, to make a long story short, my mom told him that shes talked to her father about killing my dad, my dad says he has her on tape talking about it with her father, my question is, can she get into trouble criminaly for that? talk about killing my father.

Maybe, but there would have to be evidence of some overt act she took with the goal of carrying out her plans. Depending upon the facts, her father might also be guilty of a crime if he took an overt act to help her. But just talking about killing someone is not a crime, even if she said she really wanted to do it.
