Nitrous oxide consumption

what is the maxiumum penalty by law for the consumption of nitrous oxide? generally, do people found guilty serve time for admitting consumption of a small amount of nitrous?

For several reasons I can't imagine how a charge of consuming nitrous oxide could be made to stick. They would have to prove you were unlawfully in possession - this would exclude "Whippets�" whipped-cream cartridges, used Reddi-Wip� cans, and auto grade nitrous - and that you inhaled some - did they test it? test your blood/urine? take it to the lab? Seems beatable to me.
